Prices are quoted in US-$ (US-Dollar) f.o.b. DeKalb for non US mail addresses, f.o.b. delivered to US addresses.

Please note that all invoices should be paid to Ernst Benary of America, Inc.

Ernst Benary gives no warranty express or implied, as to description, quality productiveness, or any other matter of any seeds sent out, and will not in any way be responsible for the crop. The same applies to
failure of condition and infection with noxious matter. In all instances, Benary’s liability is limited to the invoice price of the article in question. 

Complaints on outward appearance and on the weight of the seed must be lodged within 7 days, complaints on the germination within 30 days from the day of shipping from any Ernst Benary facility.

Seed must be returned in the original packing and condition within 60 days of the ship date for full credit. Seed returned within 61 days to 179 days of ship date, is subject to approval and a 15% restocking fee.
No credit or replacement will be given on seed that was purchased 180 days (6 months) past original ship date. 

No seed may be returned without first obtaining written authorization from Ernst Benary. Seed that is returned without authorization will not be accepted and credit will not be issued. No original open packages will be accepted.

If the purchaser does not accept the goods on these terms, they are at once to be returned at purchaser’s expenses. Seeds will be supplied on the understanding that they are used for production of plants only, not for any reproduction of seeds.

The goods are shipped at purchaser's risk, charges for packing, postage, freight and insurance will be borne by the consignee.  

For shipments outside the USA, if import licences are necessary, the number should be stated to effect shipment. As far as regulations permit, the instructions of the purchaser will be complied with

After 60 days a charge of 1.5% per month on the unpaid balance will be charged.

The minimum order value is US$ 75.-. Orders under US$ 75.- will be charged a US$ 30.- handling fee.

An additional packaging fee of US$ 0.75 will be charged for all multiple seed packages of the same item, smaller than 5,000 seeds, not including a single 1,000 bulk seed pack.

Orders are accepted based on these terms and conditions. Placement of orders affirms customer’s agreement to these terms.

This Price List is valid from April 1, 2011 until new pricing is published or reviewed.
