The following terms are valid for both companies:

Ernst Benary gives no warranty express or implied, as to description, quality productiveness, or any other matter of any seeds he sends out, and he will not in any way be responsible for the crop. The same applies to failure of condition and infection with noxious matter. In all instances, his liability is limited to the invoice price of the article in question. Complaints on outward appearance and on the weight of the seed must be lodged within a week, those on the germination within a month from the day of arrival at the destination.

If the purchaser does not accept the goods on these terms, they are at once to be returned. Packets which have been opened cannot be taken back. Seeds will be supplied on the understanding that they are used for production of plants only, not for any reproduction of seeds.

The goods are shipped at purchaser's risk, charges for packing, postage, freight and insurance will be borne by the consignee. If import licences are necessary, the number should be stated to effect shipment. As far as regulations permit, the instructions of the purchaser will be complied with.

Terms:

60 days net, 30 days 1 %.
After 60 days a charge of 1 1/2 % per month on the unpaid balance will be charged.

The minimum order is US$ 50.00. Orders under US$ 50.00 will be charged a US$ 10.00 handling fee.

If you request bulk seed to be repackaged into smaller units an extra fee of US$ 0.35 per unit is charged (for example: if you order 1 kg and request this packed 10 x 100 grams there is a special packaging charge of 9 x US$ 0.35).

All sales are made on the basis of the above terms, which are accepted by our customers when placing their orders.

This Price List is valid from April 1, 2008 until publication of the new price list.
